TERMS OF USE

Please read these Terms of Use carefully. They govern your access to and use of the TICK'IT website located at www.tickit.co, the TICK'IT mobile application (the "App"), and all related services, features, content, and platforms (collectively, the "Services" or "TICK'IT Properties"). By accessing or using the Services, you agree to be bound by these Terms of Use. If you do not agree, you must not use the Services.
These Terms of Use incorporate our Privacy Policy and Purchase Terms by reference.
1. About Us
1.1 TICK'IT comprises various group companies, including TICK IT HOLDINGS LTD (UAE), TICK IT SAL (440 Dimitri Hayek Street, Sin El Fil, Lebanon), TICK IT TECHNOLOGIES LTD (UK), and TICK IT EXHIBITIONS SPORTS LLC (UAE) (together, the "TICK'IT Group"). These Terms of Use are issued on behalf of the TICK'IT Group, so when we mention "TICK'IT", "we", "us" or "our", we are referring to the relevant company in the TICK'IT Group.
1.2 TICK'IT operates an online marketplace and ticketing platform that enables users to purchase tickets to events. We act as an agent on behalf of event organisers, promoters, venues, and other event partners ("Event Partners"). Unless expressly stated otherwise, TICK'IT is not the organiser of the events listed on our Services.
2. Definitions
In these Terms of Use:
- "Account" means a registered user account on the Services.
- "Buyer" means a user who purchases a Ticket through the Services.
- "Event Partner" means the promoter, organiser, venue, artist, or other third party responsible for an event.
- "Ticket" means a ticket or other right of entry to an event purchased through the Services.
- "User" means any individual who accesses or uses the Services, whether registered or not.
3. Account Registration
3.1 To access certain features of the Services, you must create an Account. When registering, you agree to provide true, accurate, current, and complete information, and to maintain and promptly update this information.
3.2 You must be at least 13 years old to create an Account. If you are under 18 (or the age of majority in your jurisdiction), you represent that you have the consent of a parent or legal guardian. You must be of legal age to form a binding contract in order to purchase Tickets.
3.3 You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You must immediately notify TICK'IT of any unauthorised use of your Account.
3.4 You are strongly encouraged to change your password at regular intervals and to use a secure password avoiding easily identifiable combinations. TICK'IT may impose a password expiration date after which you will be required to change your password.
3.5 In the event of a loss or theft of your device, or if you have reason to believe that your login information has been lost, stolen, misappropriated, or compromised in any way, you must immediately notify TICK'IT at support@tickit.co. You may be asked to provide proof of the complaint lodged with the relevant police authorities. In the absence of such information and until proven otherwise, any use of the Account is deemed to be accomplished by you. TICK'IT may take all appropriate measures to prevent any unauthorised access to your Account, including resetting your password or suspending access to the Account.
3.6 Each Account must be linked to a unique individual with valid and verifiable information. You may not maintain more than one Account per platform. TICK'IT reserves the right to suspend or terminate Accounts that contain false or duplicate information.
3.7 You may connect your Account through a third-party social networking service ("SNS"). Your relationship with the SNS provider is governed solely by your agreement with that provider. TICK'IT disclaims liability for personal information provided by such SNS in violation of your privacy settings.
3.8 You have no ownership or property interest in your Account. All rights in and to your Account are owned by TICK'IT.
4. Acceptable Use
4.1 You agree that you will not, under any circumstances:
- Use the Services for any unlawful purpose or in violation of any applicable laws or regulations;
- Use automated tools, bots, scrapers, crawlers, or similar technology to access, search, or interact with the Services;
- Interfere with or disrupt the integrity or performance of the Services;
- Attempt to gain unauthorised access to any part of the Services, other users' accounts, or computer systems connected to the Services;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software used in the Services;
- License, sell, rent, lease, transfer, assign, reproduce, distribute, or commercially exploit the Services;
- Frame or mirror any part of the Services, or use metatags or hidden text using TICK'IT's name, trademarks, or logos;
- Upload or transmit viruses, malware, or other harmful code;
- Collect, harvest, or solicit personal information from other Users;
- Use the Services to build a competing product or service;
- Create multiple Accounts to circumvent ticket limits or other restrictions;
- Engage in abusive contestation regarding the non-reception of a Ticket, including any manoeuvre aimed at making TICK'IT believe that you have not received a Ticket or have not personally purchased a Ticket;
- Use fraudulent payment methods, including credit or debit cards of which you are not the legitimate holder without authorisation. In case of suspicion of fraudulent usage, you must notify TICK'IT without delay and provide all relevant information.
5. Intellectual Property
5.1 The Services and all content therein, including but not limited to text, graphics, logos, icons, images, audio, video, software, and the design, selection, and arrangement thereof, are the property of the TICK'IT Group, its licensors, or other content providers, and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
5.2 TICK'IT grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for personal, non-commercial purposes in accordance with these Terms. This licence does not include the right to copy, reproduce, distribute, create derivative works of, publicly display, or commercially exploit any content on the Services.
5.3 All trademarks, service marks, and trade names displayed on the Services are the property of the TICK'IT Group or their respective owners and may not be used without prior written permission.
6. User Content and Feedback
6.1 Any ideas, suggestions, feedback, or proposals you submit to TICK'IT ("Feedback") shall become the sole and exclusive property of TICK'IT. You hereby grant TICK'IT a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable right and licence to use, reproduce, modify, adapt, publish, distribute, and display such Feedback for any purpose.
6.2 You represent and warrant that you have all necessary rights to submit any Feedback and that such Feedback does not infringe the rights of any third party.
7. Fees and Payments
7.1 TICK'IT may charge service fees, booking fees, and/or delivery fees in connection with purchases made through the Services ("Service Fees"). All applicable fees will be disclosed to you before you complete a purchase.
7.2 Service Fees charged by TICK'IT are non-refundable in the event of cancellation or postponement of an Event by the Event Partner, except in the event of a fault or failure by TICK'IT in providing the Services (for instance, in case of a documented technical malfunction of the platform that prevented you from presenting a valid Ticket to the Event Partner).
7.3 We accept payment via credit card (Visa, MasterCard, and other accepted issuers), and such other payment methods as indicated on the Services, including cash payment via OMT, WHISH Money, and Bob Finance where available.
7.4 Third-party payment processing is handled by Stripe, Areeba, and/or Bob Finance. By using these payment services, you agree to their respective terms and privacy policies.
7.5 By providing your payment information, you authorise TICK'IT to charge the applicable fees to your designated payment method. You agree to notify TICK'IT immediately of any changes to your billing information.
7.6 Credit/debit card details and personally identifiable financial information will not be stored, sold, shared, or rented to any third parties.
8. Ticket Purchasing
8.1 The purchase of Tickets is governed by our separate Purchase Terms, which are incorporated into these Terms of Use by reference. Please read the Purchase Terms carefully before making any purchase.
8.2 TICK'IT may impose limits on the number of Tickets a user may purchase for any given event. Attempts to circumvent ticket limits (including through multiple Accounts or automated means) may result in the cancellation of orders and suspension of your Account.
9. Platform Availability and Maintenance
9.1 TICK'IT undertakes to make the Services available to Users twenty-four hours a day (24/7), seven days a week, except in case of force majeure, unforeseeable and unavoidable behaviour of a third party, and except for possible breakdowns and/or maintenance operations necessary to ensure the proper functioning of the Services.
9.2 In the event of a malfunction and/or scheduled maintenance of the Services for more than 12 hours, TICK'IT shall notify Users to the email address specified in their Account at least twenty-four (24) hours in advance, or as soon as possible when there is an unforeseen malfunction or event.
9.3 Users are notified of the availability of updates to the Services and the consequences of not implementing them. Updates are offered at no additional cost.
9.4 The User acknowledges and agrees that due to internet network specificities, the technologies used, and telecommunications networks, TICK'IT cannot guarantee permanent availability of the Services. In the event of any malfunction or defect, TICK'IT will make reasonable efforts to restore the situation as soon as possible.
10. Disclaimer of Warranties
10.1 THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TICK'IT GROUP EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10.2 TICK'IT does not warrant that: (a) the Services will meet your requirements; (b) the Services will be uninterrupted, timely, secure, or error-free; (c) the results obtained from the Services will be accurate or reliable; or (d) any defects in the Services will be corrected.
10.3 TICK'IT does not verify the statements, listings, or representations of Event Partners, sellers, or other users, and makes no warranty regarding the validity, quality, safety, or legality of any Ticket or event.
11. Limitation of Liability
11.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE TICK'IT GROUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
11.2 The total aggregate liability of the TICK'IT Group to you for all claims arising out of or relating to the Services shall not exceed the greater of: (a) the total amount paid by you to TICK'IT during the twelve (12) months immediately preceding the event giving rise to the claim; or (b) one hundred US dollars (USD $100).
11.3 Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be lawfully excluded or limited under applicable law.
11.4 Legal Guarantee of Conformity
Users based in the United Kingdom, France, or the European Economic Area may benefit from a legal guarantee of conformity that covers the digital Services provided by TICK'IT. In accordance with this guarantee, TICK'IT shall be liable for any lack of conformity discovered within a period of two (2) years from the provision of the digital Services. 12. Indemnification
You agree to indemnify, defend, and hold harmless the TICK'IT Group and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your violation of any applicable law or regulation.
13. Third-Party Services and Links
The Services may contain links to, or integrations with, third-party websites, services, or applications. TICK'IT does not control and is not responsible for the content, privacy practices, or availability of such third-party services. Your use of any third-party service is at your own risk and subject to that third party's terms and conditions.
14. Governing Law and Dispute Resolution
14.1 The governing law and dispute resolution mechanism for any claim arising out of or relating to these Terms depends on the TICK'IT Group entity with which you are transacting and/or your location:
- Users in Lebanon: These Terms are governed by the laws of Lebanon. Disputes shall be subject to the exclusive jurisdiction of the courts of Beirut, Lebanon.
- Users in the United Kingdom and EEA: These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in the EEA, you shall also benefit from any mandatory provisions of the consumer protection law of your country of residence.
- Users in the UAE and GCC: These Terms are governed by the laws of the United Arab Emirates. Disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
- All other users: These Terms are governed by the laws of the United Arab Emirates. Disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
14.2 Nothing in this clause limits your right to bring proceedings in your country of residence where required by applicable consumer protection law.
15. Informal Dispute Resolution
15.1 In the event of a dispute, you or TICK'IT must first provide written notice setting forth the name, address, and contact information of the party giving notice, the facts giving rise to the dispute, and the relief requested ("Notice of Dispute"). Notices should be sent to legal@tickit.co.
15.2 You and TICK'IT will attempt to resolve any dispute through informal negotiation within sixty (60) days from the date the Notice of Dispute is sent. If the dispute is not resolved within this period, either party may pursue the remedies available under Section 14.
15.3 For users in the European Union, the European Commission provides an online dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr/. Users may also file a claim with a consumer mediation service in accordance with the applicable consumer protection laws of their country of residence.
15.4 For users in the United Kingdom, you may refer complaints to an alternative dispute resolution (ADR) provider. Further details of applicable ADR providers can be obtained from your local citizens advice bureau or trading standards office.
16. Term and Termination
16.1 These Terms remain in effect for as long as you use the Services.
16.2 TICK'IT may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms, suspected fraud, or as required by law.
16.3 You may terminate your use of the Services at any time by ceasing to use them and, if applicable, closing your Account.
16.4 Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, indemnification, and limitation of liability.
16.6 Following termination or closure of your Account, you may request access to the following information by contacting support@tickit.co:
- Access to receipts and purchase confirmations for a period of one (1) year from the date of termination;
- Access to Tickets for Events taking place after termination (except in cases of fraud);
- Any personal data to which you are entitled under applicable data protection law.
16.7 If your Account is terminated for violation of these Terms, you may not re-register or create a new Account without TICK'IT's prior written consent.
17. Changes to These Terms
17.1 TICK'IT reserves the right to modify these Terms at any time. If we make material changes, we will provide notice through the Services, by email, or by other appropriate means at least 30 days before the changes take effect.
17.2 Your continued use of the Services after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
18. General Provisions
18.1 Entire Agreement. These Terms, together with the Privacy Policy and Purchase Terms, constitute the entire agreement between you and the TICK'IT Group regarding the Services and supersede all prior agreements and understandings.
18.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
18.3 Waiver. No failure or delay by TICK'IT in exercising any right under these Terms shall operate as a waiver of that right.
18.4 Assignment. You may not assign or transfer your rights under these Terms without TICK'IT's prior written consent. TICK'IT may assign its rights and obligations under these Terms to any member of the TICK'IT Group or to a successor in connection with a merger, acquisition, or sale of assets.
18.5 Force Majeure. TICK'IT shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, or internet/telecommunications failures.
18.6 Notices. We may provide notices to you via email, in-app notification, or by posting on the Services. You may provide notices to TICK'IT by emailing legal@tickit.co.
18.7 Limitation Period. Any cause of action arising out of or related to the Services must commence within one (1) year after the cause of action accrues, to the maximum extent permitted by applicable law. Otherwise, such cause of action is permanently barred.
